All intellectual property rights and all other rights regarding AmpliFlow belong to the Company or, where applicable, its suppliers. Nothing in these Terms of Service shall constitute an assignment or transfer of any intellectual property rights or other rights in the software to you. However, the data that you process and that is created by the software as a result of your use thereof shall be owned by you without restriction. The Company has the right to use your data only to the extent required to fulfill its obligations under this Agreement. We may use aggregate and anonymized information for statistical purposes without restriction, provided that such information does not identify you or any individual.If a separate Data Processing Agreement (DPA) has been entered into between you and the Company, the DPA governs the processing of personal data and takes precedence over this section to the extent of any conflict.

A customer may opt out of the use of its customer-specific data for training or fine-tuning of AI or machine learning models, beyond the processing required to deliver the AI features the customer has explicitly enabled, by sending a written request to privacy@ampliflow.com.

By posting your Contributions to any part of the Service, you automatically grant, and you represent and warrant that you have the right to grant, to us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right and license to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, reformat, translate, transmit, excerpt (in whole or in part), and distribute such Contributions for any purpose, commercial, advertising, or otherwise. This license includes the right for us to use Contributions for the purpose of developing new service offerings, templates, and for gaining insights to enhance our consulting services.

The Service may utilize third-party artificial intelligence (" AI ") providers to deliver certain functionalities, including but not limited to:

The Service may use third-party artificial intelligence (" AI ") providers to deliver optional AI features such as drafting, rephrasing, summarizing, risk analysis, and control-text suggestions.

- Text generation

AI features are not enabled by default. A tenant administrator must enable the relevant AI capability and approve the selected AI provider before AmpliFlow sends customer content to that provider. The tenant administrator represents that they are authorized to approve AI use and the selected AI provider for the organization.

- Image, video generation

When an AI feature is used, AmpliFlow sends only the context needed for that specific task. This may include user-entered content, uploaded or referenced business content, user identifiers, tenant metadata, technical request metadata, and the AI-generated response. You remain responsible for ensuring that the data you submit to AI features may lawfully be processed for that purpose.

- Analytics and data processing

Depending on the AI provider approved by your tenant administrator, task-specific data may be shared with third-party AI providers such as Berget AI AB, OpenAI, LLC, Google LLC, Mistral AI, Anthropic PBC, or additional AI or cloud vendors specified at the time of opt-in, solely to provide the opted-in AI functionality. No AI provider is enabled by default.

- If you actively opt in to AI features, data - including personal data - may be shared with third-party AI providers such as OpenAI, LLC, Google LLC, Mistral AI, Anthropic PBC, among others, solely for the purpose of providing the opted-in functionality. AI features are not enabled by default. If a separate Data Processing Agreement (DPA) has been entered into, transfers to third-country AI providers are additionally governed by the DPA.

AI output is generated by probabilistic systems and may be inaccurate, incomplete, biased, outdated, or unsuitable for your intended use. AI features are decision-support tools only and do not provide legal, compliance, safety, financial, medical, or other professional advice. You are responsible for independently reviewing, validating, approving, and deciding whether to use any AI output. To the maximum extent permitted by applicable law, we are not liable for loss, damage, claims, or other consequences arising from your use of or reliance on AI output, except to the extent caused by our breach of these Terms, the Privacy Policy, applicable law, gross negligence, or wilful misconduct.
